Dakota County Judge Richard Spicer was reprimanded by the Board on Judicial Standards Friday.
The BJS doesn’t share Spicer’s sense of humor.
The reprimand references a list of statements Spicer made to a jury pool in 2011. The board concluded the statements were demeaning and insulting and “crossed the line of decorum and propriety.”
Spicer made the comments came during a case of a man charged with disorderly conduct and violating a restraining order.
According to the BJS:
When a juror said she knew the defense attorney because they had shared a hotel room during a choir trip for the juror’s daughter, Spicer said “Shared a room … I don’t want to hear about that.”
Later, a deputy entered the courtroom, and Spicer said, “He wants make sure we’re safe. I don’t know; we have a couple women sleeping together but besides that everything is O.K.”
He told a juror with a 42 year-old-child: “You don’t look much older than 42 yourself. … Wow. Wow. Very good.”
He told another juror with four children: “Well,… you weren’t shooting blanks. We know that much.”
Spicer also told the jury it should be done with deliberations in time for him to make a golf tournament.
The jury convicted the man and he appealed. The Minnesota Court of Appeals found there was not adequate proof the man’s right to a fair trial was affected by Spicer’s comments.
Spicer said he was unable to comment on the case per the BJS instructions. He told the BJS that he made the statements to make the jurors more comfortable. He waived his right to a hearing to contest the charges.
This is the second time in four years Spicer has been disciplined by the BJS.
