Court Upholds Airline Passenger?s Claim of First Amendment Retaliation

In a lengthy, divided opinion that explored the scope of protected speech in the sometimes tense environment of an airport security checkpoint, the Fourth Circuit has allowed to move forward a man's claim that authorities retaliated against him for exercising First Amendment rights by arresting him after he went through a security checkpoint with the text of the Fourth Amendment written on his chest.
