Ferguson Unrest Focuses Attention on Rights of Protesters

The clashes between protesters and police in Ferguson, Mo., have put a spotlight on the rights of protesters and the power of the police to control unrest. The courts generally have taken the view that the First Amendment rights to free speech and assembly provides strong protections to demonstrators engaging in peaceful protests, says Kevin F. O'Neill, a law professor at Cleveland-Marshall College of Law and former legal director for the American Civil Liberties Union of Ohio. But they also haven’t put many limits on the amount of force police may use to break protests up when they become disorderly.
